Shipping Policy

ARTICLE 1. PURPOSE

This shipping policy aims to define the terms and conditions applicable to the shipment of a Product to the Client by the Publisher.

ARTICLE 2. PARTIES

This shipping policy applies between Stanfield, SASU, share capital: €1000, registered with the RCS of 75001 in France on 01/03/2024, under number 985143783, head office: 229 Rue Saint-Honoré, 75001 Paris, FR, phone: +33184603424, email: contact@massage-gun.com, VAT number: FR53985143783, hereinafter referred to as “the Publisher,” and any private or public individual or entity registered on the Site to purchase a Product, hereinafter referred to as “the Client.”

ARTICLE 3. DEFINITIONS

“Client”: Any private or public individual or entity registered on the Site.

“Site Content”: Elements of any kind published on the Site, whether protected by intellectual property rights or not, such as texts, images, designs, presentations, videos, diagrams, structures, databases, or software.

“The Publisher”: Stanfield, SASU, acting in its capacity as the site’s publisher.

“Internet User”: Any private or public individual or entity accessing the Site.

“Product”: Goods of any kind sold on the Site by the Publisher to Clients.

“Site”: The website accessible at the URL massage-gun.com, including sub-sites, mirror sites, portals, and related URL variations.

ARTICLE 4. SCOPE

The Site is freely accessible to any Internet User. Browsing the Site implies acceptance of this shipping policy by any Internet User. Mere connection to the Site, by any means, including via a robot or browser, constitutes full acceptance of this shipping policy. Upon registration on the Site, this acceptance is confirmed by ticking the corresponding box.

The Internet User acknowledges having fully read and accepted it without restriction.

Ticking the aforementioned box will be considered equivalent to a handwritten signature by the Internet User. The Internet User acknowledges the evidential value of the Publisher’s automatic recording systems and, unless proven otherwise, waives the right to contest them in the event of a dispute.

This shipping policy applies to the relationship between the parties to the exclusion of all other conditions, including those of the Internet User.

Acceptance of this shipping policy requires that Internet Users possess the legal capacity necessary for this purpose, or failing that, have the authorization of a guardian or curator if they are incapacitated, from their legal representative if they are minors, or hold a mandate if acting on behalf of a legal entity.

ARTICLE 5. DELIVERY

5.1. Shipping Fees

Shipping or delivery fees will, in any case, be indicated to the Client before any payment and only apply to deliveries made in mainland France, including Corsica. For any other delivery location, the Client must contact customer service.

In the event of a Product delivery to the Client in-store or at a location partnered with the Publisher, the related fees are specified to the Client at the time of the order.

The shipping fees indicated on the Site are in euros, inclusive of all taxes.

5.2. Delivery Time

Orders are delivered by La Poste, DPD, Chronopost, Mondial Relay, Geodis, DHL, FedEx, UPS, EMS within 14 to 45 working days from the Publisher's full receipt of the payment.

Some products or order volumes may justify a delivery time of more than 14 working days. This will be expressly mentioned to the Client when confirming the order.

5.3. Damaged Package

In the event of the delivery of a package that is visibly and clearly damaged, the Client must refuse it to benefit from the guarantee offered by the carrier. The Client must also inform the seller immediately so that a new package can be prepared and sent once the damaged package is received back. In such cases, the delivery times indicated above in these general conditions will no longer apply.

5.4. Retention of Title – Transfer of Risk

The ownership of delivered Products remains with the Publisher until the Products are delivered to the Client, notwithstanding any contrary clause, unless the parties have specifically and expressly agreed in writing to waive this clause.

The Client assumes the risks related to the Products from the time of the order. Throughout the retention of title, the Client must insure the Products belonging to the Publisher against all damage at their own expense and provide proof to the Publisher upon first request.

ARTICLE 6. FINAL PROVISIONS

6.1. Applicable Law

This shipping policy is subject to French law.

6.2. Amendments to this Shipping Policy

This shipping policy may be amended at any time by the Publisher. The shipping policy applicable to the Client is the one in effect on the day of their order or connection to the Site, with any new connection to the personal area implying acceptance of the new shipping policy, where applicable.

6.3. Disputes

Under Ordinance No. 2015-1033 of August 20, 2015, any disputes with a consumer Client that may arise in the context of executing these general conditions and whose solution could not be found amicably between the parties must be submitted.

Since January 1, 2016, mediation is mandatory for all. Thus, any professional selling to individuals must provide the contact details of a competent Mediator in the event of a dispute, regardless of whether they sell remotely or in a physical store (Source: FEVAD).

6.4. Entirety

The nullity of one of the clauses of this contract will not result in the nullity of the other clauses of the contract or the contract in its entirety, which will retain their full effect and scope. In such a case, the parties must, as far as possible, replace the nullified stipulation with a valid stipulation corresponding to the spirit and purpose of these terms.

6.5. Non-Waiver

The Publisher's failure to exercise the rights recognized under these terms shall not be interpreted as a waiver of asserting said rights.

6.6. Telephone Solicitation

The Client is informed that they can register on the opt-out list against telephone solicitation at http://www.bloctel.gouv.fr/.

6.7. Languages of This Shipping Policy

This shipping policy is offered in French.

6.8. Unfair Clauses

The provisions of this shipping policy apply subject to compliance with the mandatory provisions of the Consumer Code concerning unfair terms in contracts concluded between a professional and a consumer.
